Thank you for visiting the Mail Garden Shop website (the "Site"). By using this Site, you accept these Terms. If you do not accept these Terms, do not use this Site. We may change these Terms from time to time and if we change these Terms, we will post the revised document here, so you should review them each time that you visit the Site. You should print a copy of these Terms for future reference.

1.1. This Site is operated by Mail Garden Shop, a division of J. Parker Dutch Bulbs (Wholesale) Ltd. a company registered in England under company number 1467306 with a registered office at 14-16 Hadfield Street, Old Trafford, Manchester, M16 9FG ("we", "us", "our"). 2. Using our Site

2.1. We are the owner or licensee of all intellectual property rights in the Site and the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

2.2. You may view (and, where applicable, listen to) the content available on the Site for personal non-commercial use. You may occasionally print individual webpages on the Site for your private non-commercial use, provided that such printing is not substantial or systematic and our trade marks and copyright and trade mark notices are not removed.

2.3. Unless otherwise stated in these Terms, you must not (whether directly or indirectly) copy, download, store, make available, distribute, sell or offer to sell all or any part of the content or Site, or download or otherwise copy (whether directly or indirectly) any content, files or data from the Site to make or populate a database or publication of any kind whatsoever.

2.4. You may only play video or audio files using the media player on our Site.

2.5. You must not use all or any part of our Site or the contents on it for commercial purposes without our permission.

3. Registration

3.1. You must be 18 years old or older to register to the Site.

3.2. Only one registration per person is allowed. You must keep your registration information up to date.

3.3. You must choose an email address which gives you frequent access to emails sent to that address, as we need to be able to contact you. You must keep your password confidential.

3.4 You must not:

(i) impersonate or try to impersonate another person;

(ii) disclose your password to anyone else;

(iii) allow anyone else use your account;

(iv) use anyone else's account.

3.5. You are responsible for everything done using your account. If you think that someone else may have access to, or be using, your password or account, you must tell us as soon as possible by emailing mailgardenshop@jparkers.co.uk

4. Suspending or terminating your registration

4.1. We may suspend, terminate or prevent your registration or restrict or deny you access to all or some of the parts of the Site at our sole discretion. This may be because, for example, we consider that you have breached or will breach these Terms.

5. Third party content and links available on this Site

5.1. We are not liable or responsible for the third party content on this Site. Third party content includes, for example, comments posted by users and the content of advertisements.

5.2. Where this Site contains links to other sites and resources, which are provided by third parties, these links and resources are provided for your information only and you access them at your own risk. We are not liable or responsible for the content of third party sites or resources.

6. Material submitted by you and your personal information.

6.1. We will use your personal information in accordance with our privacy policy, which forms part of these Terms. Please read our Privacy Policy now.

6.2. Except for information that identifies you personally (e.g. your name, address, telephone number, email address), any material which you submit will be considered non-confidential and non-proprietary such that we shall have the right to use, copy, distribute and disclose it to third parties for any purpose.

6.3. You agree not to submit any material:

6.3.1. that is false, misleading, defamatory, discriminatory, threatening, offensive, abusive, likely to cause someone anxiety or distress, encourages violence or racial or religious hatred, blasphemous, pornographic, in breach of confidence, in breach of privacy; or

6.3.2. that infringes any intellectual property rights, such as copyright and trade marks. This means generally that you must own the rights in everything you submit or must obtain permission from the rights owner to submit the material; or

6.3.3 which is technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data); or

6.3.4 which encourages or teaches conduct that is a criminal offence, gives rise to civil liability, or is otherwise unlawful.

6.4. We are not obliged to use material submitted by you and we may remove from the Site, any of the material submitted by you at our sole discretion.

6.5. We will fully co-operate with any law enforcement authorities or court order requesting or directing us to disclose the identity of anyone submitting material in breach of clause 6.3.

6.6. We will not be responsible, or liable to any third party, for the content or accuracy of any materials submitted by you.

7. Our liability

7.1. The information contained on this Site is for information purposes only and does not constitute advice. You should check any information on the Site and use your own judgment before doing or not doing anything on the basis of what you see. We give no warranties of any kind in relation to the Site or its contents.

7.2. Except for liability for fraudulent misrepresentation, we are not liable for:

(a) any action you may take as a result of relying on any information provided on this Site or for any loss or damage suffered by you as a result of you taking this action;

(b) any dealings you have with third parties (e.g. other users, advertisers or promoters) that take place using or facilitated by the Site;

(c) any liability for losses which are not a foreseeable or likely consequence of (i) your use of the Site, or (ii) a breach of these Terms.

7.3. We are not responsible if you cannot access the Site properly or at all because of any event outside our control, for example (without limitation) the performance of your or our ISP, your browser or the Internet.

7.4. The Site relies in part on software to work. Software has bugs. Whilst we will monitor the Site and try to fix bugs, we cannot guarantee that the Site or any individual feature of the Site will be error free, available all the time and/or free from viruses.

7.5. However, nothing in these Terms will affect any liability we may have for death or personal injury arising from our negligence or any other liability which cannot be excluded or limited by law.

8. Maintenance of the Site

8.1. Making your use of the Site enjoyable means we need to fix bugs, install updates and do general diagnosis and maintenance of the Site. We will try to do scheduled maintenance during times when we anticipate that online use is lower than normal.

8.2. We also need to be able to do emergency maintenance and/or suspend access to the servers where, in our reasonable discretion, we see the need to do that. We will try to have the Site available again as soon as we think it is safe to do so.

9. Validity of these Terms

9.1. If any part or provision of these Terms is found to be unlawful or unenforceable, this shall not affect the validity of any other part or provision.

10. Complaints

10.1 In the event that we are unable to resolve a dispute with you, you can make a complaint via the ODR platform which can be located here: http://ec.europa.eu/consumers/odr/. The ODR can then submit the dispute to an ADR. We are obliged to inform you that we do not recognise any ADR's.

11. Jurisdiction and applicable law

11.1. These Terms are governed by English law. The English courts shall have exclusive jurisdiction over any dispute relating to these Terms.

Use of Your Details

All confidential information, including credit card details, is held securely and only transmitted in encrypted form. Any confidential information which you provide to us from which we can identify you, is held and processed in accordance with our Data Protection Registration. Further details are set out in our Privacy Policy .

Credit Card Payments

Unfortunately we do not accept Amex payments.


Most products are delivered within 14 days, however please refer to the product page for more information on delivery.

All special offers are subject to availability. Free gifts and special offer discounts are only available at the time of ordering. If no free gift is specified on your order, none will be sent. We reserve the right to withhold certain offers for customers reaching our site via affiliate websites and other similar websites. Voucher codes such as percentage discounts, etc., may not be used in conjunction with any other offers.

Making a contract with us

When you place an order with us, you are making an offer to buy goods. In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, we will email you to inform you of this. If the goods you order are not available, we may supply you with substitute goods. If you decide not to accept the substitute goods, you will be able to return them to us at no cost to yourself.

Refunds and Replacement Policy

All our products are of the highest products, all of our plants and bulbs carry a money back or replacement guarantee. If for any reason you are not satisfied with your purchase, please advise us within 14 days and we will offer a replacement (subject to availability) or refund. Should you wish to return an unwanted order please return goods to the address below within 14 days of receipt of order for a refund or replacement. Upon returning the goods please advise whether you would like a refund or replacement. Please note we will not refund the postage cost for goods returned to us which are not faulty or damaged. We will process the refund or replacement on receipt of the returned order. Once the refund is processed please allow 3 to 5 working days to credit your account.
